Everton to appeal after being given new points deduction by the Premier League

Everton say in a statement that they are to appeal again after being given a new points deduction by the Premier League.

The club were deducted a further two points for another Profitability and Sustainability Rules breach, meaning they will dropped one place to 16th in the table.

They were docked 10 points in November for breaching PSR, reduced to six after putting in an appeal, something which they are to do again for this latest deduction.

CLUB STATEMENT:

In January 2024, Everton were charged by the Premier League for breaching the permitted Profit and Sustainability thresholds for the assessment period ending 2022/23.

The matter was referred to a Premier League Commission, which has today announced Everton will receive an immediate two-point deduction. While the Club’s position has been that no further sanction was appropriate, the Club is pleased to see that the Commission has given credit to the majority of the issues raised by the Club, including the concept of double punishment, the significant mitigating circumstances facing the Club due to the war in Ukraine, and the high level of co-operation and early admission of the Club’s breach.

Everton remains committed to working collaboratively with the League on all matters relating to PSR but is extremely concerned by the inconsistency of different commissions in respect of points deductions applied.

The Club would like to place on record its thanks to the Fan Advisory Board and other fan groups for their submissions during this process, and to all Evertonians for their ongoing patience and unstinting support.

The Club and its legal representatives have begun the preparations to appeal the Commission’s decision.

No further comment will be made at this time.

In a statement the league said: “Over a three-day hearing last month, the independent Commission heard evidence and arguments from the club in respect of a range of potential mitigating factors for its admitted breach of £16.6million, including the impact of its two successive PSR charges. Having done so, the Commission determined the appropriate sanction to be a two-point deduction, taking effect immediately.

Laura Scott (BBC Sport senior news reporter on Radio 5 Live):We now have a situation where Everton have been docked two points on top of the six points they have already been docked. That first deduction was initially 10 and it was reduced on appeal. They now have another deduction, and they could appeal this [the club have confirmed they are appealing the decision]. With Nottingham Forest’s four-point deduction we have the Premier League table looking like a bit in chaos because of profit and sustainability rules which clubs are finding have some teeth to them.

“Everton fans are quite understandably going to be annoyed by the toing and froing because it will have a major impact on whether they survive in the Premier League. You can see from Everton’s statement there is clear frustration with the rules and about how the commission is making these decisions. This is new ground at the moment and there’s not a great deal of precedent to these decisions, but fans will point to the differing penalties.

“From an Everton perspective you can see why there’s not a great deal of consistency because the breach from the charge before was £19m and this is a breach of £16.6m. You have got clubs frustrated with these rules and not quite understanding them. If they aren’t, with expensive lawyers, then you have to think of fans across the country who are scratching their heads.”

Simon Stone of BBC Sport:A couple of points have come to light within the written reasons for the case.

“The Premier League believed Everton were ‘reckless’ in their spending and felt the starting point for their behaviour was a five-point deduction.

“Also, in the notes, it appears this case might not be finished.

“As the decision records, there remains a dispute between the Premier League and the club as to the status of certain costs that the club says are associated with its stadium construction.

“The league considers that these costs fall to be considered as a loss for the purposes of the PSRs.

“The club contends that these costs are not losses, given that they relate to the construction of the stadium and have been capitalised in their audited accounts.

“This issue, and the question of whether any additional sanction should be applied, will be resolved by the same Commission at a later date.

“Basically – the league think the stadium should count as a loss. Everton say it’s audited in their stadium accounts and not a loss.

“It could lead to a further deduction, although that would not apply this season.”

Sky Sports News’ Anton Toloui at Goodison Park:

“The points deduction is based on what has been called a ‘significant breach’ of the rules. They were allowed to lose up to £105m. They had already been deducted 10 points for breaching those rules in the previous financial year, which was reduced to six on appeal.

“They released their accounts for last year last week and it was an £89.1m loss. Everton lost significant revenue in that period, such as the USM sponsorship deal through Alisher Usmanov.

“The Premier League are saying they have taken double jeopardy into account, but Everton have breached the rules and they felt there had to be a sanction.

“They are trying to set a benchmark for other clubs to follow these rules because there is so much ambiguity over what has happened with Everton and Nottingham Forest.

“The Premier League season finishes on May 19 but they have set aside May 25 to have all these appeals heard and dealt with. They would love everybody to know where they stand going into the final weekend but can’t guarantee that at the moment.

“At least Everton now know the worst-case scenario. They are now two points above the relegation places and they have some huge games, starting with Monday Night Football against Chelsea (next week). They then face three games at Goodison Park in just six days.

“In a points-deduction derby, they take on Nottingham Forest, then Liverpool in the Merseyside derby, and then Brentford – who they are now two points below in the table.

“Remember, they still have to play Luton and Sheffield United. Sean Dyche was saying he just wanted clarity and they now have that.”

@joe_strange: Just all so grim, isn’t it? League table being decided by a commission rather than on the pitch. Deductions being plucked from thin air with zero consistency. Appeals dragging on and other clubs being affected. Everton deserve punishment but the process is a farce.
