Birmingham City given suspended points deduction by the EFL

Birmingham City have been given a suspended two-point deduction for by the EFL for breaching rules, first reported by John Percy.

He said: This is related to the owners and directors’ test last year (MaxCo taking control without approval). While a serious sanction, it should be viewed by fans as the final nail for BSHL.

This comes only days after American financier Tom Wagner bought a 45,64% stake in the Blues, who finished 17th in Championship with 53 point from 46 games.

The club says the hedge fund manager will purchase 24% shares of Birmingham Sports Holdings Limited, Blues’ parent.

A further 21.64% shares will be transferred by Oriental Rainbow Investments to Achiever Global Group.

Shelby Companies Limited, a company owned by Wagner’s Shelby Companies Limited, will also own Birmingham’s St Andrew’s.

The English Football League and Hong Kong Stock Exchange must both approve the deal.

Birmingham announced that the club will remain under the control and management of its current board until EFL has approved the owner and director’s tests and contracts have been completed.

EFL STATEMENT:

Birmingham City Football Club is to be deducted two points, suspended until the end of the 2023/24 season, after admitting to a breach of EFL Regulations.

Following a thorough investigation, the Club was charged in February with breaching the Owners and Directors’ Test after they allowed a number of individuals to bring themselves within the definition of a Relevant Person and to acquire Control of the Club without the prior approval of the EFL.

Those individuals received sanctions last month and the Club has now entered into an Agreed Decision, with the EFL which includes the suspended sporting sanction and liability for the associated costs of the investigation.

In addition, Birmingham City’s owner, Mr Vong Pech, has entered an Agreed Decision with the EFL after admitting to a breach of EFL Regulations when he permitted those individuals to acquire control of the Club without the prior approval of the EFL. Mr Vong Pech was issued with a warning and reprimand, and is liable to pay the costs of the investigation.

BIRMINGHAM STATEMENT:

Birmingham City Football Club has entered into an Agreed Decision with the English Football League (EFL) in relation to charges issued on Monday 20 February 2023 concerning the Owners’ and Directors’ Test (OADT).

This follows an investigation by the EFL into the proposed acquisition of control of the Club by Maxco Capital Co Ltd.

The Club has cooperated fully with the EFL throughout the investigation and has accepted a two-point deduction, suspended until the end of the 2023/24 season. The suspended deduction will only come into effect upon any future breach of the OADT before the end of next season. In addition, the Club will make a contribution to the EFL’s costs of the investigation.

Whilst the Club has accepted the charges, the EFL has acknowledged a number of relevant circumstances in this particular matter and has recognised that the Club took extensive steps during the potential takeover to avoid any potential breach of the OADT.

The Club is satisfied that a prompt resolution has been reached during the season.

@almajir: It sounds bad, but in reality it should be okay as it’s suspended. It shows how important it is for these takeovers to be professional and to toe the line – and I’m sorry to those Maxco cheerleaders, but this is why I think PR etc shouldn’t ever be involved.

The EFL will announce the sanction, and there will be a time limit on the suspension.
As long as we don’t do it again, no point deduction.
Will it impact on the inevitable Mr King charges? I don’t think so, but we will see soon enough.
